1.商标:
商标名称是用于在其经营所在州内将企业注册为法人的名称。通常,这通常是在国务卿或公司部或同一国营机构中进行的。商标名称在其注册所在州内必须是唯一的。出于联邦税法的目的,该商品名称还已在美国国税局内部注册。

商标可以是以图形方式表示的标志或符号,并且能够使一项企业的产品或服务与其他企业的产品或服务区分开。商标注册申请应向财产部商标注册处提出。注册商标的所有者具有将商标用于在香港特别行政区注册的产品和服务的特权。

例子 :

2.域名:

您可以从注册商处以您的特定名称购买网站名称。至少要向一个注册服务商提出在国家代码顶级域名(例如com.hk)或通用顶级域名(例如.com)下注册网站名称的申请。如果网站名称可以发现特定商品或服务的来源,那么通常可以将其注册为商标。

例子 :

商标和域名之间的区别:

S.NO TRADE MARK DOMAIN NAME
1. A trade mark may consist of words, designs, letters, numerals, colors, the shape of goods or their packaging etc. and any combination of such signs. A domain name must be contextual in for (e.g. www.ipd.gov.hk).
2. A trade mark would be registered in respect of the goods or services as classified under the Nice Classification. A domain name does not have to be registered for a particular class of goods or services.
3. A registered trade mark is valid for 10 years and can be renewed for further periods of 10 years. A domain name is only for a particular period as agreed between the registrant and the accredited registrar and these are subject to renewal.
4. A trade mark may not be registrable if it is different or similar to a previously registered trade mark. A domain name is registrable if it is not different to a previously registered domain name.
5. A trade mark which consists exclusively of a sign or a symbol which describes the characteristics for the applied-of goods or services may not be registrable. Symbols such as “fresh bread” in respect of bakery services. A domain name may describe the features of the application-of goods or services, e.g. “freshbread.com” for a bakery.
6. Trademark operates in the real world. Domain name operates in the cyber world.
7. Different people living in different countries may have the same trademark for different goods and services as it does not generally have a global impact on it. Domain names operates at a global level and so no two companies/persons can be having the same domain name.
8. Trademark can refer to or linked to a specific category of a product or products line. The domain names are not given for every single product offered by a company.
9. As there are no jurisdiction issues, the dispute related to a trademark can be easily settled. As the internet is very wide and does not any any boundaries, so the disputes are hard to be settled.
